Terms and Conditions (T&C) – Intiwawa

1. Scope
1.1. These terms and conditions govern the use of the online shop www.intiwawa.shop as well as all contracts between:

and the customers of the shop.

1.2. These terms and conditions apply equally to consumers and business customers. Deviating terms and conditions of the customer shall not be recognized unless we have expressly agreed to them in writing.

2. Conclusion of Contract
2.1. The products displayed in the shop do not constitute a legally binding offer but an invitation to order.

2.2. The customer makes a binding purchase offer by placing products in the shopping cart and completing the ordering process via “place order with obligation to pay”.

2.3. After receiving the order, you will receive an automatic confirmation. The purchase contract is only concluded with the shipping confirmation or, in the case of prepayment, with the order confirmation/payment request.

2.4. If a product is not available, we will inform you immediately and refund any payments already made without delay.

2.5. The delivered goods remain the property of the seller until full payment has been received.

3. Prices and VAT
3.1. All prices in the shop are final prices, including statutory VAT.

3.2. Shipping costs are shown separately and displayed during the ordering process.

3.3. For deliveries abroad, additional fees such as customs duties or import VAT may apply and are borne by the customer.

4. Payment Methods
4.1. You can pay using the following methods:

  • Klarna

  • Apple Pay

  • Google Pay

4.3. Payment is due immediately after ordering. The goods remain the property of the seller until full payment has been received.

5. Delivery and Delivery Times
5.1. Deliveries are made to the address provided by the customer within Germany.

5.2. The delivery time is usually 3–5 business days after receipt of payment.

5.3. Partial deliveries are permissible if reasonable.

5.4. Obvious transport damage must be reported in writing within 14 days of receipt.

 

6. Right of Withdrawal
6.1. Consumers have the right to withdraw from the contract within 14 days without giving any reason.

6.2. Personalized products or products made to customer specifications are excluded from the right of withdrawal.

6.3. The return costs are borne by the customer.

6.4. Details on the withdrawal as well as a model withdrawal form are available on the website under “Right of Withdrawal”.

 

7. Warranty
7.1. We are liable for material and legal defects in accordance with statutory provisions, in particular §§ 434 ff. BGB. For consumers, the limitation period is two years from delivery of the goods. When the goods are used for commercial or self-employed professional purposes, the period is one year.

7.2. In addition to the statutory claims, certain products may be covered by seller or manufacturer guarantees. The scope and conditions of such guarantees are specified in the enclosed guarantee information.

 

8. Liability
8.1. We are fully liable for damages caused intentionally or by gross negligence.

8.2. In the case of simple negligence, we are only liable for the breach of essential contractual obligations (so-called cardinal obligations), limited to the foreseeable, typical damage.

8.3. Liability for damage to life, body, or health remains unaffected.

 

9. Return Instructions
9.1. Please return the goods as unused as possible and in the original packaging.

9.2. These instructions facilitate the return process but are not a prerequisite for the effectiveness of the withdrawal.

 

10. Applicable Law and Jurisdiction
10.1. German law applies, excluding the UN Sales Convention.

10.2. Consumers residing abroad retain the mandatory rights of their country.

10.3. The place of jurisdiction for merchants with registered office in Germany is Munich.

10.4. We do not participate in dispute resolution proceedings before consumer arbitration boards.
